Sexual discrimination and equal pay

This applies to men and women of any age and outlaws discrimination against people on the grounds of gender. This area of the Equality Act also incorporates equal pay: the comparator is always someone of the opposite sex.

It is now possible to claim discrimination by association and discrimination by perception. A clause in a contract that forbids employees to discuss pay with other employees is no longer enforceable if the discussion is being used to identify discrimination. Any action taken against an employee for taking part in such a discussion could be victimisation.
